Divorce Divorce

Most divorces today are “no-fault,” based on the decision of either the husband or the wife that the marriage has become insupportable, which gives either of them the legal right to terminate the marriage contract. The public policy of this state is to encourage divorcing couples to take a long moment of reflection before divorcing because it is a serious milestone in a person’s life, and an event that should not be taken lightly. For that reason, marriage counseling and mediation are encouraged, and a sixty day waiting period between the date of filing the original petition for divorce and the first day the court will have jurisdiction to enter a final decree of divorce is mandatory. Texas is a community property state, which means that all property acquired during the marriage is legally presumed to be jointly owned by the husband and wife and will be subject to division by the court, usually half to each party in the case of a no-fault divorce. If one party is at fault for the breakup of the marriage, he or she may receive a significantly smaller share of the community estate. Property owned prior to the marriage, in addition to gifts and inherited property, will usually be treated as the separate property of the spouse who can prove the separate property claim , and will not be subject to division by the court. Divorces account for approximately 50% of our case load.
