The Texas Probate Code requires, in most cases, that a decedent’s estate be probated within four years of his or her death, whether or not he or she left a written will. There are exceptions, and in any case, an heirship proceeding may be available at any time to transfer property to the heirs of the decedent. Property that transfers by contract, such as a life insurance policy or a bank account with a P.O.D. or survivorship provision, will usually not be a part of a probate estate, but anything else that is titled in the name of a person who has died, particularly real estate, will require that legal documents be filed to complete the transfer to the legal heirs. The process can usually be completed in thirty to ninety days, depending on the complexity of the estate. Uncooperative heirs can add enormous complications and delays, however, so it is often advisable to consider family settlement conferences wherever possible.
